These Terms and Conditions govern the use of the website www.mylandscape.store and the purchase of artworks, prints, and other artistic items from my online store. By accessing or using the website, you agree to comply with these Terms and Conditions. Please read them carefully before making any purchase.
Orders
1.1. Orders will be processed and shipped within up to 3 weeks from the purchase date unless otherwise specified.
1.2. I offer international delivery. Delivery costs and estimated delivery times will be displayed at checkout. By purchasing, both you and I agree to these terms.
1.3. Any customs duties, taxes, or other additional costs arising from the import of goods into the buyer’s country and imposed by the destination country are the buyer’s responsibility.
Prices and Payments
2.1. All prices displayed on my website include applicable fees and taxes.
2.2. I accept various payment methods, including credit cards, debit cards, Apple Pay, Google Pay, PayPal, and PayPal 4x. You agree to provide accurate and complete payment information when placing an order.
2.3. In the case of a pricing error on my website, I reserve the right to cancel or modify an order or contact you for further instructions.
Returns and Refunds
3.1. I take great care in ensuring the quality and safe packaging of my products. However, if you receive a damaged or defective item, please contact me within 7 business days of receiving your order. You must provide photos or videos of the damaged box or product.
3.2. In the event of damage or loss during transit, I will initiate a return or refund or provide a replacement item, subject to availability. Refunds will be credited to your account within 7 business days after receiving the painting and verifying its condition.
3.3. To be eligible for a return or refund, the item must be in its original condition and packaging. You are responsible for safe packaging; otherwise, I will charge 50% of the product’s cost in cases of insufficient packaging. Both parties will assess the situation and determine solutions. Although such cases have not occurred, it’s best to handle art carefully to avoid material losses.
3.4. Exceptions to returns:
If the delivery company is unable to deliver the package due to the buyer’s fault, the buyer will cover the cost of re-delivering the painting. If the address is incorrect or incomplete due to an error on my part during shipping, I will assume the costs of repeated delivery.
If the painting, reproduction, or any other product arrives at a pickup point but the client does not collect it within the timeframe specified by the delivery company, the client will need to arrange for a repeat delivery. In the case of refusal, both the returned product to Paris and the payment will not be refunded.
Intellectual Property Rights
4.1. All artworks, prints, and other artistic items available on my website are protected by copyright and other intellectual property rights. Purchasing an item does not grant you rights to the associated intellectual property.
4.2. You may not reproduce, modify, distribute, or use copyrighted materials from my website without prior written consent from me or the copyright holder.
Limitation of Liability
5.1. I strive to provide accurate and reliable information on my website but do not guarantee its completeness, accuracy, or reliability. Using my website is at your own risk.
5.2. Under no circumstances will I be liable for direct, indirect, incidental, special, or consequential damages resulting from the use of my website or the purchase of my products.
Governing Law and Jurisdiction
6.1. These Terms and Conditions are governed by the laws of the European Union.
6.2. Any dispute arising from or related to these Terms and Conditions will be subject to the exclusive jurisdiction of the courts in France. If you wish to initiate legal action in your own country, you will bear the legal costs.
By using my website and making a purchase, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, please do not use my website or make purchases.
Additional Useful Information
If you request paintings or prints in different sizes or on other materials, purchases are made directly by contacting me via email at serge@mylandscape.store (please include the desired dimensions and relevant photo references).
The edges and backs of the paintings are painted blue. Once a custom order is approved, the painting is usually completed within eight (8) weeks to allow for complete drying before shipping (additional fees for size and weight will be discussed and included or excluded from the price).
If I accept your request, I will provide an approximate completion date and payment instructions. You will be added to my order list only after full payment has been made. If, for any reason, I cannot complete the painting by the agreed date, you will receive a full refund via the original payment method, or we will agree on new terms.
Unless otherwise agreed, paintings are varnished (except when the technique or subject does not allow for it), unframed, and do not have hanging devices on the back. These decisions remain at the discretion of the client, who can apply them after receiving the artwork.
